Pink Cab OU – Terms of Service
Effective Date: February 4, 2026
These Terms of Service (“Terms”) govern your access
to and use of Pink Cab OU (“Pink Cab,” “we,” or “us”),
a mobile application and service operated by Pink Cab, an Ohio
University–affiliated student organization. By creating an account, accessing,
or using the Pink Cab app on iOS or Android, you agree to be bound by these
Terms and our Privacy Policy, incorporated herein by reference. If you do not
agree to these Terms, you may not access or use the Service.
Definitions and User Roles
For purposes of these Terms, the following groups are
recognized within the Pink Cab OU organization and the Service:
- Officers
Officers are officially designated leaders of Pink Cab OU who oversee the
overall operation, policy, and governance of the Service. Officers have
the highest authority in interpreting and enforcing these Terms, including
account suspensions, terminations, and policy updates.
- Admins
Admins are authorized users responsible for day-to-day moderation and
operational management of the Service. Admins may review user accounts,
verify credentials, enforce conduct rules, manage ride disputes, and
temporarily suspend or ban users in accordance with these Terms.
- Volunteers
Volunteers are individuals who assist the organization in
non-administrative capacities, including safety monitoring, incident
review, user support, and outreach. Volunteers may have limited access to
user-submitted content strictly for operational or safety purposes, under
the supervision of Officers or Admins.
- Developers
Developers are individuals who design, maintain, or update the Service’s
software, including application code, infrastructure, and technical
features. Developers may have access to technical systems and user data
solely for the purpose of operating, debugging, and improving the Service,
and are subject to confidentiality obligations.

2. Description of Service
Pink Cab is a ridesharing and transportation platform
designed to allow approved users to request and fulfill rides within the Ohio
University community. The Service provides:
- Ride requests and driver matching
- In-app payments and optional tipping
- Messaging between riders and drivers
- Incident reporting and moderation
The Service is limited to Ohio University–affiliated users
and is intended to operate primarily in and around the Ohio University campus
(Athens, Ohio), with pricing and distance calculations relative to College
Green.
3. Eligibility
- Users must be 18 years of age or older.
- Users must have the legal capacity to enter into a binding
agreement.
- Access is restricted to individuals affiliated with Ohio
University. Pink Cab reserves the right to verify university affiliation
and reject or terminate accounts at its discretion.
4. Account Registration and Security
- All users must create an account to access any
functionality of the Service.
- Users are responsible for maintaining the confidentiality
of account credentials. Pink Cab employs secure authentication methods,
including password hashing, two-factor authentication (2FA/MFA), JWT-based
session management, and encrypted transmission (HTTPS/WSS, TLS 1.2+).
- Account sharing is prohibited.
- Users are solely responsible for all activity conducted
through their accounts, including ride requests, cancellations, payments,
messaging, and reports.
- Pink Cab reserves the right to suspend, lock, or
permanently terminate accounts at its discretion for violations of these
Terms, safety concerns, or misuse of the Service.
5. Rides, Payments, and Fees
- The app is free to download. Users pay a per-ride fee
after ride completion, including optional tips.
- Payments are processed exclusively via Stripe. No cash or
external payments are supported.
- Refunds are discretionary and not guaranteed.
- Users acknowledge that drivers are independent service
providers and that Pink Cab is not responsible for rides, cancellations,
or conduct during rides.
6. User Content and License
- Users may submit profile photos, student ID photos,
driver’s license and vehicle images (drivers only), messages, and incident
reports.
- Users retain ownership of all content submitted.
- By submitting content, users grant Pink Cab a limited,
non-exclusive, royalty-free license to host, store, display, process,
modify, and review such content solely for operating, maintaining, and
enforcing safety and moderation within the Service.
- Prohibited conduct includes, but is not limited to: abuse,
harassment, unsafe or illegal activity, false verification, impersonation,
account sharing, data scraping, reverse engineering, and circumvention of
security or payment systems. Violations may result in suspension or
termination.
7. Intellectual Property
- All code, branding, logos, UI, text, workflows, pricing
logic, and system designs are the sole property of Pink Cab.
- Users may not copy, modify, distribute, create derivative
works, reverse engineer, or otherwise attempt to access internal logic or
source code.
8. Data Usage and Privacy
- The Service collects personal data necessary for
operation, verification, and safety, including but not limited to: first
& last name, preferred pronouns, OU OHIO ID, PID, enrollment date,
expected graduation date, profile photo, ride data, payment metadata,
messages, and incident reports.
- Driver accounts are subject to collection of vehicle and
drivers license pictures, driver’s license number, license plate number, and
the year, make, model, and color of the registered vehicle.
- Use of the Service constitutes explicit consent to
collection, processing, storage, and use of personal data in accordance
with our Privacy Policy.
- The Privacy Policy is incorporated by reference and must
be reviewed and accepted in addition to these Terms.
9. Third-Party Services
- The Service relies on third-party providers including
Stripe (payment processing), AWS (cloud hosting), Mapbox (maps, routing,
distance calculation), and Firebase (notifications).
- Pink Cab is not responsible for outages, errors, or
failures of third-party services. Users agree to comply with the
third-party terms of use and disclaim any claims against Pink Cab related
to third-party failures.
10. Termination
- Pink Cab may suspend or terminate accounts at any time
without prior notice for violations of these Terms, safety concerns,
fraud, or loss of eligibility.
- Upon termination, users’ access to content is revoked.
Pink Cab may retain content as necessary for legal compliance, safety
records, or financial obligations.
- Sections concerning Intellectual Property, Disclaimers,
Limitation of Liability, Indemnification, Governing Law, and Data Usage
survive termination.
11. Disclaimers
- The Service is provided “as-is” and “as-available” without
warranties of any kind, express or implied, including fitness for a
particular purpose or uninterrupted service.
- Pink Cab does not guarantee safety, accuracy, reliability,
or suitability of rides or content.
- Downtime, technical errors, or interruptions may occur.
12. Limitation of Liability
- To the fullest extent permitted by law, Pink Cab is not
liable for: personal injury, property damage, losses from rides, user
misconduct, payment disputes, or indirect, incidental, consequential, or
punitive damages.
- Users agree to indemnify and hold harmless Pink Cab, its Officers,
Admins, Volunteers, and Developers from claims, damages, or expenses
arising from their use of the Service or violations of these Terms.
13. Governing Law and Dispute Resolution
- These Terms are governed by the laws of the State of Ohio,
USA, without regard to conflict-of-law principles.
- Users agree to submit to the exclusive jurisdiction of
state or federal courts located in Ohio for any disputes, unless Pink Cab
elects alternative mediation or arbitration.
- Users agree to bring claims only individually, not as part
of a class or representative action.
- Users agree to comply with all U.S. export control laws
and not to use the Service from sanctioned jurisdictions.
14. Changes to Terms
Pink Cab may update the Terms of Service at any time.
Updates will be communicated via one or more of the following methods:
- In-app notification
- Banner or modal message
- Email notification
- Updated acceptance required on next login
Continued use of the Service constitutes acceptance of the
updated Privacy Policy.
15. Special Disclaimers
- The Service is intended solely for users aged 18 or older;
COPPA and GDPR-K are not applicable.
- The Service does not provide medical, emergency, or
financial advice.
- Drivers are independent users, not employees or agents of
Pink Cab.
